MX3 Consulting

Terms of Service

Effective July 8, 2026 · Version 2026-07-08

1. Agreement

These Terms of Service ("Terms") are a binding agreement between you ("Client," "you") and Mobile Money LLC, doing business as MX3 Consulting ("MX3," "we," "us"). By checking the agreement box during onboarding, or by using the platform after being provisioned, you accept these Terms.

2. The Service

MX3 provides a hosted business operating system: a client-facing storefront, an owner administration portal, and related automation (lead capture, scheduling, order/appointment management, and analytics), delivered as a licensed, multi-tenant platform rather than a one-off website build.

3. Fees & Billing

Your plan's recurring fee is disclosed to you before you're provisioned and is billed on a recurring basis until cancelled by either party. Fees are non-refundable except where required by law or expressly stated in writing. We may change pricing for future billing cycles with at least 30 days' notice.

4. Payment Collection & Payout (Pass-Through Clause)

Where your account is connected to your own Stripe account ("Connected Payments"), your customers pay you directly and MX3 never holds your funds.

Where your account is not yet connected to your own Stripe account, MX3 may act as a limited collection agent on your behalf: your customers' payments are collected into MX3's own payment processing account, and MX3 remits your share to you on the payout schedule stated in your plan (minus any agreed platform fee), typically on a periodic ledger basis rather than per-transaction. This arrangement is a convenience during onboarding, not a banking or money-transmission service, and MX3 will transition your account to Connected Payments as soon as it is set up.

You are responsible for your own tax reporting on amounts received. MX3 is not responsible for delays in payout caused by incomplete account information on your part.

5. Chargebacks & Disputes

For funds collected under the pass-through arrangement in Section 4, MX3 may deduct chargeback, refund, or dispute amounts from your next payout, or invoice you directly if a payout has already been made.

6. Your Content

You retain ownership of your business content (copy, images, listings, customer data you collect). You grant MX3 a license to host, display, and process that content solely to operate the service for you.

7. Termination

Either party may terminate with written notice. On termination, MX3 will make a reasonable effort to export your data on request and will settle any outstanding pass-through payout owed to you under Section 4.

8. Disclaimers & Limitation of Liability

The service is provided "as is." To the maximum extent permitted by law, MX3's total liability arising from these Terms is limited to the fees you paid in the three months preceding the claim.

9. Changes to These Terms

We may update these Terms as the platform evolves. Material changes will be presented for re-acceptance at your next login. Continued use after non-material changes constitutes acceptance.

10. Contact

Questions about these Terms: reach us through the email associated with your onboarding application, or at privacy@mx3hq.com. How we handle personal information is covered in our Privacy Policy.

This is a starting template, not a substitute for review by a licensed attorney — particularly Section 4, before real customer payments run through the pass-through arrangement.
